Condicions d’Ús

Aquestes Condicions d’ús (les «Condicions») regulen l’ús de l’aplicació Dejuni («l’App»). En descarregar o utilitzar l’App acceptes aquestes Condicions. Si no hi estàs d’acord, no utilitzis l’App.

1. Què és Dejuni

Dejuni és una aplicació de seguiment de dejuni intermitent. Et permet registrar els teus períodes de dejuni, la teva hidratació i el teu pes, i t’ofereix recordatoris i un seguiment del teu progrés. Dejuni és una eina de seguiment; no és un dispositiu mèdic.

Avís important sobre salut. Dejuni no proporciona consell mèdic, diagnòstic ni tractament, i no substitueix l’opinió d’un professional sanitari. El dejuni intermitent no és adequat per a tothom. Consulta el teu metge abans de començar, especialment si estàs embarassada o en període de lactància, ets menor d’edat, tens o has tingut un trastorn de la conducta alimentària, pateixes diabetis o una altra condició metabòlica, prens medicació o tens qualsevol problema de salut. Si et trobes malament mentre dejunes, atura’t i busca atenció mèdica. Fas servir l’App sota la teva responsabilitat.

2. Subscripció, prova gratuïta i pagaments

Dejuni funciona mitjançant una subscripció de pagament. Les funcions de l’App requereixen una subscripció activa; no hi ha una versió gratuïta permanent.

  • Prova gratuïta: la subscripció pot incloure un període de prova gratuït de 7 dies. Si no la canceles abans que finalitzi la prova, es convertirà automàticament en una subscripció de pagament.
  • Plans i preus: els plans disponibles i el seu preu exacte es mostren de manera clara a l’App i a l’App Store abans que confirmis la compra.
  • Cobrament: el pagament es carrega al teu compte d’Apple ID en confirmar la compra. Tots els pagaments els gestiona Apple.
  • Renovació automàtica: la subscripció es renova automàticament pel mateix període i preu, llevat que la cancel·lis com a mínim 24 hores abans del final del període en curs.
  • Cancel·lació: pots gestionar o cancel·lar la subscripció en qualsevol moment des dels Ajustos del teu compte de l’App Store. La cancel·lació té efecte al final del període ja pagat.
  • Reemborsaments: els reemborsaments els gestiona Apple segons les seves polítiques. Els teus drets com a consumidor a la Unió Europea no es veuen afectats.

3. Ús acceptable

Et comprometes a usar l’App d’acord amb la llei i a no: (a) copiar, modificar, descompilar ni fer enginyeria inversa de l’App llevat que la llei ho permeti; (b) intentar eludir el sistema de subscripció o les mesures de seguretat; (c) usar l’App de manera que en perjudiqui el funcionament o altres usuaris.

4. Propietat intel·lectual

L’App, el seu disseny, el seu codi i els seus continguts estan protegits per drets de propietat intel·lectual i pertanyen al titular de l’App. Aquestes Condicions et concedeixen una llicència d’ús personal, limitada, no exclusiva i intransferible; no et transfereixen cap dret de propietat.

5. Disponibilitat i garanties

L’App s’ofereix «tal qual» i «segons disponibilitat». Fem esforços raonables perquè funcioni correctament, però no garantim que estigui lliure d’errors o interrupcions. En la mesura permesa per la llei, queden excloses les garanties implícites que no siguin obligatòries per la normativa de consum aplicable.

6. Limitació de responsabilitat

En la mesura màxima permesa per la llei, no serem responsables de danys indirectes o consegüents derivats de l’ús de l’App ni de decisions relatives a la teva salut que adoptis basant-te en ella. Res en aquestes Condicions limita responsabilitats que no es puguin excloure legalment, incloses les derivades de la normativa de protecció dels consumidors.

7. Canvis en l’App o en les Condicions

Podem modificar l’App i aquestes Condicions per reflectir millores o canvis legals o tècnics. Publicarem la versió vigent en aquesta pàgina amb la seva data. L’ús continuat de l’App després de la publicació implica l’acceptació de les Condicions actualitzades.

8. Llei aplicable

Aquestes Condicions es regeixen per la legislació espanyola. Si ets consumidor, podràs acudir als tribunals del teu lloc de residència i gaudiràs dels drets imperatius que et reconegui la normativa del teu país de residència a la UE.

9. Condicions per a aplicacions de l’Apple App Store

Les condicions següents s’apliquen quan uses l’App en un dispositiu Apple i formen part d’aquestes Condicions:

  • Aquestes Condicions es formalitzen únicament entre tu i el titular de l’App, no amb Apple. El titular de l’App és l’únic responsable de l’App i del seu contingut.
  • Apple no té cap obligació de prestar serveis de manteniment o suport respecte de l’App.
  • En cas que l’App no s’ajusti a qualsevol garantia aplicable, podràs notificar-ho a Apple i Apple et reemborsarà el preu de compra, si n’hi ha. En la mesura permesa per la llei, Apple no tindrà cap altra obligació de garantia respecte de l’App.
  • El titular de l’App, i no Apple, és responsable d’atendre qualsevol reclamació relativa a l’App, incloses les relatives a responsabilitat per producte, incompliment legal o regulatori, protecció del consumidor i infracció de drets de tercers.
  • En cas de reclamació d’un tercer per infracció de drets de propietat intel·lectual, el titular de l’App, i no Apple, en serà responsable.
  • Declares que no et trobes en un país subjecte a embargament del Govern dels EUA ni figures en cap llista de parts prohibides o restringides dels EUA.
  • Apple i les seves filials són tercers beneficiaris d’aquestes Condicions i en podran exigir el compliment.

Estos Términos de Uso (los «Términos») regulan el uso de la aplicación Dejuni («la App»). Al descargar o utilizar la App aceptas estos Términos. Si no estás de acuerdo con ellos, no utilices la App.

1. Qué es Dejuni

Dejuni es una aplicación de seguimiento de ayuno intermitente. Te permite registrar tus periodos de ayuno, tu hidratación y tu peso, y te ofrece recordatorios y un seguimiento de tu progreso. Dejuni es una herramienta de seguimiento; no es un dispositivo médico.

Aviso importante sobre salud. Dejuni no proporciona consejo médico, diagnóstico ni tratamiento, y no sustituye la opinión de un profesional sanitario. El ayuno intermitente no es adecuado para todas las personas. Consulta a tu médico antes de empezar, especialmente si estás embarazada o en periodo de lactancia, eres menor de edad, tienes o has tenido un trastorno de la conducta alimentaria, padeces diabetes u otra condición metabólica, tomas medicación o tienes cualquier problema de salud. Si te sientes mal mientras ayunas, interrumpe el ayuno y busca atención médica. Usas la App bajo tu propia responsabilidad.

2. Suscripción, prueba gratuita y pagos

Dejuni funciona mediante una suscripción de pago. Las funciones de la App requieren una suscripción activa; no existe una versión gratuita permanente.

  • Prueba gratuita: la suscripción puede incluir un periodo de prueba gratuito de 7 días. Si no cancelas antes de que finalice la prueba, esta se convertirá automáticamente en una suscripción de pago.
  • Planes y precios: los planes disponibles y su precio exacto se muestran de forma clara en la App y en la App Store antes de que confirmes la compra.
  • Cobro: el pago se carga en tu cuenta de Apple ID al confirmar la compra. Todos los pagos los gestiona Apple.
  • Renovación automática: la suscripción se renueva automáticamente por el mismo periodo y precio, salvo que la canceles al menos 24 horas antes del final del periodo en curso.
  • Cancelación: puedes gestionar o cancelar la suscripción en cualquier momento desde los Ajustes de tu cuenta de App Store. La cancelación surte efecto al final del periodo ya pagado.
  • Reembolsos: los reembolsos los gestiona Apple según sus políticas. Tus derechos como consumidor en la Unión Europea no se ven afectados.

3. Uso aceptable

Te comprometes a usar la App conforme a la ley y a no: (a) copiar, modificar, descompilar o realizar ingeniería inversa de la App salvo en la medida permitida por la ley; (b) intentar eludir el sistema de suscripción o las medidas de seguridad; (c) usar la App de forma que perjudique su funcionamiento o a otros usuarios.

4. Propiedad intelectual

La App, su diseño, su código y sus contenidos están protegidos por derechos de propiedad intelectual y pertenecen al titular de la App. Estos Términos te otorgan una licencia de uso personal, limitada, no exclusiva e intransferible; no te transfieren ningún derecho de propiedad.

5. Disponibilidad y garantías

La App se ofrece «tal cual» y «según disponibilidad». Hacemos esfuerzos razonables para que funcione correctamente, pero no garantizamos que esté libre de errores o interrupciones. En la medida permitida por la ley, quedan excluidas las garantías implícitas que no sean obligatorias por la normativa de consumo aplicable.

6. Limitación de responsabilidad

En la medida máxima permitida por la ley, no seremos responsables de daños indirectos o consecuentes derivados del uso de la App ni de decisiones relativas a tu salud que adoptes basándote en ella. Nada en estos Términos limita responsabilidades que no puedan excluirse legalmente, incluidas las derivadas de la normativa de protección de los consumidores.

7. Cambios en la App o en los Términos

Podemos modificar la App y estos Términos para reflejar mejoras o cambios legales o técnicos. Publicaremos la versión vigente en esta página con su fecha. El uso continuado de la App tras la publicación implica la aceptación de los Términos actualizados.

8. Ley aplicable

Estos Términos se rigen por la legislación española. Si eres consumidor, podrás acudir a los tribunales de tu lugar de residencia y disfrutarás de los derechos imperativos que te reconozca la normativa de tu país de residencia en la UE.

9. Condiciones para aplicaciones de la Apple App Store

Las siguientes condiciones se aplican cuando usas la App en un dispositivo Apple y forman parte de estos Términos:

  • Estos Términos se celebran únicamente entre tú y el titular de la App, no con Apple. El titular de la App es el único responsable de la App y de su contenido.
  • Apple no tiene obligación alguna de prestar servicios de mantenimiento o soporte respecto de la App.
  • En caso de que la App no se ajuste a cualquier garantía aplicable, podrás notificarlo a Apple y Apple te reembolsará el precio de compra, si lo hubiera. En la medida permitida por la ley, Apple no tendrá ninguna otra obligación de garantía respecto de la App.
  • El titular de la App, y no Apple, es responsable de atender cualquier reclamación relativa a la App, incluidas las relativas a responsabilidad por producto, incumplimiento legal o regulatorio, protección del consumidor e infracción de derechos de terceros.
  • En caso de reclamación de un tercero por infracción de derechos de propiedad intelectual, el titular de la App, y no Apple, será responsable de su gestión.
  • Declaras que no te encuentras en un país sujeto a embargo del Gobierno de EE. UU. ni figuras en ninguna lista de partes prohibidas o restringidas de EE. UU.
  • Apple y sus filiales son terceros beneficiarios de estos Términos y podrán exigir su cumplimiento.

These Terms of Use (the “Terms”) govern your use of the Dejuni application (the “App”). By downloading or using the App you accept these Terms. If you do not agree to them, do not use the App.

1. What Dejuni is

Dejuni is an intermittent-fasting tracking application. It lets you log your fasting periods, hydration and weight, and provides reminders and progress tracking. Dejuni is a tracking tool; it is not a medical device.

Important health notice. Dejuni does not provide medical advice, diagnosis or treatment, and is not a substitute for the judgement of a healthcare professional. Intermittent fasting is not suitable for everyone. Consult your doctor before starting, especially if you are pregnant or breastfeeding, a minor, have or have had an eating disorder, have diabetes or another metabolic condition, take medication, or have any health concern. If you feel unwell while fasting, stop and seek medical attention. You use the App at your own risk.

2. Subscription, free trial and payments

Dejuni works through a paid subscription. The App’s features require an active subscription; there is no permanent free version.

  • Free trial: the subscription may include a 7-day free trial. If you do not cancel before the trial ends, it will automatically convert into a paid subscription.
  • Plans and pricing: the available plans and their exact price are shown clearly in the App and on the App Store before you confirm the purchase.
  • Billing: payment is charged to your Apple ID account upon confirmation of purchase. All payments are handled by Apple.
  • Auto-renewal: the subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
  • Cancellation: you can manage or cancel the subscription at any time in your App Store account settings. Cancellation takes effect at the end of the period already paid for.
  • Refunds: refunds are handled by Apple under its policies. Your consumer rights in the European Union are not affected.

3. Acceptable use

You agree to use the App lawfully and not to: (a) copy, modify, decompile or reverse-engineer the App except to the extent permitted by law; (b) attempt to circumvent the subscription system or security measures; (c) use the App in a way that harms its operation or other users.

4. Intellectual property

The App, its design, code and content are protected by intellectual-property rights and belong to the App’s owner. These Terms grant you a personal, limited, non-exclusive and non-transferable licence to use the App; they do not transfer any ownership rights to you.

5. Availability and warranties

The App is provided “as is” and “as available”. We make reasonable efforts to keep it working properly, but we do not warrant that it will be free of errors or interruptions. To the extent permitted by law, implied warranties that are not mandatory under applicable consumer law are excluded.

6. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect or consequential damages arising from your use of the App, nor for health-related decisions you make based on it. Nothing in these Terms limits liabilities that cannot be excluded by law, including those arising from applicable consumer-protection rules.

7. Changes to the App or these Terms

We may modify the App and these Terms to reflect improvements or legal or technical changes. We will publish the current version on this page with its date. Continued use of the App after publication constitutes acceptance of the updated Terms.

8. Governing law

These Terms are governed by Spanish law. If you are a consumer, you may bring proceedings before the courts of your place of residence and you will enjoy the mandatory rights granted to you by the law of your EU country of residence.

9. Apple App Store terms

The following terms apply when you use the App on an Apple device and form part of these Terms:

  • These Terms are entered into solely between you and the App’s owner, not Apple. The App’s owner is solely responsible for the App and its content.
  • Apple has no obligation whatsoever to furnish any maintenance or support services in respect of the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
  • The App’s owner, not Apple, is responsible for addressing any claims relating to the App, including product liability, legal or regulatory non-compliance, consumer protection, and third-party intellectual-property infringement.
  • In the event of a third-party claim that the App infringes intellectual-property rights, the App’s owner, not Apple, will be responsible for handling it.
  • You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
